1. Acceptance and eligibility

These Terms & Conditions ("Terms") are an agreement between you and Central Arkansas Service Company ("CASC," "we," "us," or "our"), located at 8010 Counts Massie Rd, Ste B, North Little Rock, AR 72113. They apply to your use of this website (centralarservice.com and its review and staging copies) and to the information, forms and content on it (together, the "Site").

By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site; you can still call us at 501-307-1310. You must be at least 18 years old and able to enter a binding contract to request service or submit a form. If you use the Site for a business, you confirm you are authorized to accept these Terms for it.

Please read Section 17 carefully. It requires most disputes to be resolved by individual binding arbitration, waives jury trials and class actions, and explains how to opt out.

2. Our services

CASC provides heating, cooling, indoor air quality and plumbing services for residential and commercial customers in Central Arkansas. The Site describes our services, service areas and company. Services are available only in the areas we serve and subject to scheduling, technician availability, site conditions, safety and the equipment involved. We may decline or reschedule any job, and we may change or stop offering any service at any time.

Each job we perform is governed by the written estimate, work order, invoice, agreement and warranty documents for that job (the "Job Documents"). If these Terms conflict with Job Documents you signed, the Job Documents control for that job.

Safety first. If you smell gas, see sparking, or have flooding near electrical equipment, leave the area and call your gas or electric utility or 911 before contacting us. Submitting a website form does not notify us right away; for timely help, call 501-307-1310 during business hours.

3. Estimates, prices and scheduling

• Estimates are not binding offers. Any estimate, quote, price range or option (including tiered replacement options) is based on the information available at the time. It is not a binding contract until you and CASC sign a written agreement or work order for the job. Prices may change if conditions differ from what we expected (for example, hidden damage, code requirements, access problems or equipment availability), and we will discuss changes with you before doing extra work.
• Free estimates are offered only for HVAC system replacements, larger plumbing projects (such as water heater installs, repipes and sewer line replacements) and commercial HVAC projects. Diagnostic and repair visits carry a service-call fee.
• Prices on the Site, such as service-call fees, maintenance plan prices and the water heater flush price, are current when posted, may change without notice, and may not include tax. The price that applies is the one confirmed when you schedule or approve the work. Typographical errors do not bind us.
• Scheduling. A form submission is a request, not a confirmed appointment. An appointment is confirmed only when our office confirms it with you. Preferred days and times are not promised, and same-day service is offered only when availability allows.
• Permits and codes. When a job requires a permit, we pull it. Code and permit requirements are set by your local building department and can change; any general code information on the Site is not a statement of what your jurisdiction requires.
• Payment. Payment is due as stated in your Job Documents. The Site does not accept payments.

Nothing in these Terms limits any cancellation right you have under applicable law, such as for certain sales made at your home.

4. Service and equipment warranties

Warranties for our work and for equipment are provided only in writing, in the warranty documents given with your job, and by the equipment manufacturer. For example, new HVAC system installations come with CASC's written installation warranty (10-year parts and 2-year labor, with optional extended labor coverage available), subject to its terms, including any manufacturer registration requirements. Manufacturer warranties are provided by the manufacturer, not by CASC.

These Terms and the Site do not create any additional warranty. Descriptions of warranties on the Site are summaries; the written warranty documents control.

5. Maintenance plans, discounts and financing

• Maintenance plans. Plan benefits, visits, pricing and terms are described on our Plans page and in the plan agreement you receive. The plan agreement controls. Residential plans do not renew automatically.
• Discounts and offers (including military, first responder and senior discounts and manufacturer rebates) are subject to their stated eligibility rules, cannot be combined unless we say so, have no cash value, and may change or end at any time. Rebates are provided by manufacturers or other third parties, which decide eligibility and payment.
• Financing is offered by third parties, such as Synchrony and RTO National (lease-to-own, HVAC only). CASC is not a lender, does not make credit decisions and does not set rates or terms. Approval, rates, payments and all other terms are set by the provider under its own agreement, and the provider's terms and privacy policy govern your application. See our Financing page.

6. Website information is not professional advice

The guides, blog posts, glossary, comparisons, checklists and other content on the Site are general educational information about HVAC and plumbing. They are not engineering, legal, code, insurance, tax, financial, medical or other professional advice for your situation, and they do not replace an on-site inspection by a qualified technician. Do not attempt gas, electrical, refrigerant or other hazardous work yourself based on the Site. Information about insurance is general; we can document conditions and work, but we never decide what your insurer will cover. Product names and specifications are provided for reference and may change.

7. AI-assisted content

Some Site content, including parts of our Learning Center, was drafted with the help of artificial intelligence (AI) tools and then reviewed and edited by people. Even with that review, AI-assisted content may contain errors, be out of date, or not fit your situation, and any examples, numbers or scenarios are illustrative only. AI-assisted content is not professional advice and is not a quote or a promise. The Site does not have an AI chat, AI estimator or AI phone assistant. If you notice an error, please tell us so we can fix it.

8. No promise of particular results

Equipment performance, comfort, energy use, utility bills, indoor air quality, water quality, and repair life depend on many factors outside our control, such as the age and condition of your system, your building, usage, weather and maintenance. Except as stated in your written Job Documents and warranty, we do not promise any particular result, savings, efficiency or outcome. Statements on the Site about benefits are general and are not promises.

9. Our content and your limited license

The Site and its content, including text, guides, photos, graphics, logos, the Central Arkansas Service Company and CASC names, and the look and feel of the Site, are owned by CASC or its licensors and protected by copyright, trademark and other laws. Manufacturer names and logos belong to their owners and are used only to identify products we install or service.

We give you a limited, revocable, non-exclusive, non-transferable license to view and print Site pages for your own personal or internal business use in arranging service. You may not copy, republish, sell, frame, scrape or create derivative works from the Site, or use our names or logos, without our written permission.

10. Acceptable use

When using the Site, you agree not to:

• Submit false, misleading or someone else's information, or impersonate anyone.
• Send spam, advertising, or unlawful, harassing or harmful content through our forms.
• Upload viruses or harmful code, or try to break, overload, probe or bypass the security of the Site, its forms or its spam protection.
• Use bots, scrapers or automated tools to collect content or data from the Site, including to train AI models, except ordinary search-engine indexing.
• Use the Site in any way that violates law or the rights of others.

11. Your submissions

When you submit a form, resume, photo, review or other material ("Submissions"), you confirm it is accurate, that you have the right to share it, and that it does not violate anyone's rights. You allow us to use Submissions to respond to you, provide service, review your application and run our business as described in our Privacy Policy. If you send us feedback or ideas, we may use them without paying you. By submitting a form, you agree that CASC may contact you by phone or email about your request. We do not send text messages through the Site.

12. Third-party services and links

The Site includes or links to services run by others, such as Google Maps, Google reCAPTCHA, Google Fonts, social media sites, review sites, manufacturers and financing providers. We do not control them and are not responsible for their content, availability, security or practices. Your use of them is governed by their own terms and privacy policies, including the Google Terms of Service. A link is not an endorsement.

13. The Site is provided "as is"

TO THE FULLEST EXTENT ALLOWED BY LAW, THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, secure or free of viruses, that content is complete or current, or that a form submission will be received. This section applies to the Site only; it does not reduce any written warranty in your Job Documents or any warranty that cannot be excluded under Arkansas law.

14. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, CASC AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR LOSS OF USE, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED (A) THE AMOUNT YOU PAID CASC FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100) IF THE CLAIM RELATES ONLY TO YOUR USE OF THE SITE.

These limits do not apply to liability that cannot be limited under applicable law, such as liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by our negligence. Liability for work we perform is governed by your Job Documents and applicable law.

15. Indemnification

To the extent allowed by law, you agree to defend, indemnify and hold harmless CASC and its owners, officers, employees and agents from any claims, losses, damages, liabilities and costs (including reasonable attorneys' fees) arising from your misuse of the Site, your Submissions, your violation of these Terms, or your violation of any law or the rights of another person.

16. Governing law and venue

These Terms are governed by the laws of the State of Arkansas and applicable federal law, without regard to conflict-of-law rules. Subject to Section 17, any case that is allowed to go to court must be brought only in the state courts located in Pulaski County, Arkansas, or the United States District Court for the Eastern District of Arkansas, and you and CASC consent to those courts' jurisdiction.

17. Dispute resolution, binding arbitration and class-action waiver

Informal resolution first

Most concerns can be solved with a phone call. Before starting arbitration or a lawsuit, you and CASC agree to send the other a written notice describing the dispute and the relief requested, and to try in good faith to resolve it for 30 days. Send notices to CASC at the mailing address in Section 21; we will send ours to the contact information we have for you.

Agreement to arbitrate

If the dispute is not resolved, you and CASC agree that any dispute, claim or controversy arising out of or relating to the Site, these Terms, or any services we provide to you (unless your Job Documents contain a different dispute-resolution clause) will be resolved by final and binding individual arbitration under the Federal Arbitration Act, rather than in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or its Commercial Arbitration Rules for business customers), held in Pulaski County, Arkansas, or by phone or video if the parties agree. For consumer claims, CASC will pay any AAA filing, administrative and arbitrator fees above the amount you would pay to file in court. The arbitrator may award the same individual relief a court could award.

Exceptions

Either party may bring an individual claim in small claims court in Pulaski County (or the county where the service was performed) if it qualifies. Either party may also go to court to stop infringement of intellectual property. Nothing here stops you from reporting a concern to a government agency, such as the Arkansas Attorney General or a state licensing board.

Class-action and jury-trial waiver

YOU AND CASC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. YOU AND CASC WAIVE ANY RIGHT TO A JURY TRIAL. The arbitrator may not combine more than one person's claims. If this class waiver is found unenforceable for a claim, that claim will proceed in court (under Section 16), not in arbitration.

30-day right to opt out

You may opt out of this arbitration agreement by sending written notice within 30 days after you first accept these Terms (by using the Site or submitting a form). Mail it to Central Arkansas Service Company, Attn: Arbitration Opt-Out, 8010 Counts Massie Rd, Ste B, North Little Rock, AR 72113, or send it through our contact form with the words "Arbitration Opt-Out." Include your name, address and phone number and a clear statement that you want to opt out. Opting out does not affect any other part of these Terms.

Time limit

To the extent allowed by law, any claim relating to the Site must be started within one year after it arises, or it is permanently barred.

18. Termination

We may suspend or end your access to the Site, or change or stop the Site, at any time and for any reason, without notice. Sections that by their nature should survive (including Sections 9 and 11 through 20) survive termination.

19. General terms

• Entire agreement. These Terms, the Privacy Policy and any Job Documents are the entire agreement between you and CASC about their subjects.
• Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest stays in effect.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not transfer these Terms. We may assign them, for example to a successor business.
• Events beyond our control. We are not responsible for delays or failures caused by weather, utility outages, supply shortages, labor disputes, government action or other events beyond our reasonable control.
• Notices. We may give you notice by posting on the Site or using the contact information you gave us. Your notices to us must be in writing to the address in Section 21.
• Headings are for convenience only.

20. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the "Last updated" date. Changes apply from that date forward and do not apply to disputes that arose before the change. Continued use of the Site after an update means you accept the new Terms. A change to Section 17 will not remove your right to opt out within 30 days of first accepting it.
